1. Prior to 30 July 2025, and every six months thereafter, the approved provider must ensure that refresher training is conducted for all educators and staff working at the Service on the following policies and procedures required under regulation 168: a. Incident, injury trauma and illness procedures complying with regulation 85. b. Providing a child safe environment, including matters relating to the promotion of a culture of child safety and wellbeing, child protection awareness and mandatory reporting requirements. c. Interactions with children, including matters set out in regulation 155 and 156. d. Dealing with complaints, including matters relating to the provision of complaint handling systems that are child focused. The approved provider must submit evidence to the Regulatory Authority within one week of completion of the initial refresher training and each subsequent refresher training. This condition will be in place for an initial period of 24 months and will be reviewed by the Regulatory Authority at that time 3. From 19 May 2025 the approved provider must ensure that: a. any allegations or incidents involving physical or sexual abuse of a child in education and care at the Service b. any circumstance arising at the Service that poses a risk to the health, safety or wellbeing of a child are reported to the Regulatory Authority as soon as practicable, but not later than 24 hours, of the matter being reported to an educator, nominated supervisor, or area manager at the Service. 4. The approved provider must: a. Prepare a compliance improvement plan and submit a copy of that plan to the Regulatory Authority by 30 June 2025. b. Ensure that the compliance improvement plan addresses the following: i. Adequate supervision of children, consistent with section 165 of the National Law. ii. Taking reasonable precautions to protect children from harm or hazards, consistent with section 167 of the National Law. iii. Ensuring certain information is notified to the Regulatory Authority within prescribed timeframes, consistent with section 174 of the National Law. c. Ensure that the Compliance Improvement Plan contains, as a minimum, the following details: i. relevant section/regulation; ii. planned compliance improvement actions; iii. how the provider will monitor its own compliance and improvement actions; iv. how the provider will ensure that parent complaints are appropriately addressed v. Improvement action taken; vi. date of action taken; and vii. name and signature of person taking action. d. Submit a copy of the compliance improvement plan to the Regulatory Authority on a quarterly basis, commencing on 30 June 2025, with an update on progress. This condition will be in place for an initial period of 12 months and will be reviewed by the Regulatory Authority at that time. 6. The approved provider must notify all families in writing of any future compliance actions they receive from the Regulatory Authority within 7 days of receipt and provide a copy of this notice to the Regulatory Authority at the time of issuing.
