Approval conditions

The approved provider must ensure that, at any time children are being transported as part of the education and care service, at least one educator over the age of 18 travels in the vehicle in addition to the person driving. From 22 May 2025, the approved provider must ensure that a nominated supervisor physically present at the service conducts an audit to ensure that all staff employed by the service are following all of the service’s transportation policies, procedures and processes. This audit must include practical steps the nominated supervisor took, including observations and interactions with other staff, to ensure the service’s compliance with regulation 102D, 102E and 102F and implementation of the requirements of the risk assessment conducted under r.102AAC. The approved provider must ensure that a nominated supervisor of the service conducts the audit on behalf of the approved provider every 2 weeks. The approved provider must ensure that the nominated supervisor who conducted the audit makes and signs a written record of each audit, as outlined above, as soon as possible after the audit and within 24 hours of the audit at the latest, and that the record includes the full name and signature of the nominated supervisor, the time and date of the audit, and the details of the observations the nominated supervisor has made of other employees. The approved provider must keep these audit records available for inspection by an authorised officer, on the same basis as any document prescribed for the purpose of section 175 of the National Law.
