For the waiver for regulation 126 to apply, the service must ensure that at no time during the provision of education and care is there more than one qualified educator fewer than the number required. The risk mitigation strategies outlined in the risk assessment must be fully implemented, and evidence of implementation must be maintained The approved provider must take reasonable steps to recruit diploma qualified educators during the waiver period. The approved provider must notify the Regulatory Authority within 14 days if the waiver is no longer required.
