For the waiver for regulation 321(1) to apply, the service must ensure that at no time during the provision of education and care, is there more than one qualified educator fewer than the number required, and only for a maximum of one shift per week. The approved provider is required to continue recruitment efforts and must provide evidence of these efforts to the Education Standards Board by 30 April 2026. Evidence must include, but is not limited to: • Outcomes of advertising and recruitment activities • Strategies implemented to attract, upskill, and retain staff.
