Approval conditions

The approved provider must ensure that, where there is a swimming pool, spa or other water feature at the residence of an educator who is registered with the service, the educator must be directly supervising and physically in proximity to any child in their care who is near the swimming pool, spa or other water feature. The approved provider must notify the Regulatory Authority at least 14 days before they commence operating in another state. As of 4 June 2026, the approved provider must ensure that a written record is made of each such visit and ensure it is signed and dated on the day of the visit by both by the person who conducted the visit and by the educator. As of the 4 June 2026, the approved provider must keep these written records of visits available for inspection by an authorised officer, on the same basis as any document prescribed for the purpose of section 175 of the National Law. From the 21/7/2026 the Approved Provider must ensure that every second month the approved provider or a family day care coordinator visits the family day care residence or approved family day care venue of each and every family day care educator where an approval granted for the purposes of regulation 124(5) is required to be kept in its register of educators. The approved provider is waived from the requirements of Regulation 124 for waiver applications APP-00055833 and APP-00055834, to provide education and care to five children aged preschool age and under, but no more than seven children in total on Thursdays and Fridays during school terms between 9:15am and 2:45pm and on Thursdays and Fridays during vacation care. The approved provider is waived from the requirements of Regulation 124 for waiver application APP-00056695, to provide education and care to five children aged preschool age and under, but no more than seven children in total on Mondays and Wednesdays. From 31 December 2020 the approved provider must not engage or register a new family day care educator if there is a swimming pool or spa on the site of the proposed family day care residence unless they were in the application process prior to that date. A new educator is an educator not previously registered or engaged to provide a family day care service with any provider.
