Approval conditions

The approved provider must conduct and document evidence of an audit every eight-weeks (minimum six times per annum) to ensure that all staff employed by the service are following the service’s supervision and child safe environment policies and procedures. Evidence of compliance must be provided to the Commission via the below email at the conclusion of each eight-week period. The approved provider must complete support plans within two weeks of commencement of enrolment for any children with a diagnosis and/or requiring additional support needs. This must be completed in consultation with educators and families and where relevant, therapists or support agencies, ensuring that a timeframe is set for ongoing review and updates. These plans will be checked during subsequent visits. The approved provider must ensure that six-monthly performance appraisals are conducted and recorded to assess all educators’ performance and develop current and ongoing goals to support consistency of practice among all educators. The appraisal must include supervision, child safety, interactions with children and allergy management as key areas for regular discussion and assessment of practice. These appraisals will be checked during subsequent visits. All new employees must undergo a detailed induction, and a record must be kept of each new educator’s details, including their WWCC, staff information, and how their knowledge and understanding of your policies (including, but not limited to, supervision, child safety, interactions with children, and allergy management) have been assessed. These inductions will be checked during subsequent visits. The approved provider must ensure that six-monthly refresher training is conducted for all educators and staff working at the service on the following policies and procedures required under Regulation 168: a)Providing a child safe environment, including matters relating to supervision, promoting a culture of child safety and wellbeing, child protection awareness, and mandatory reporting requirements. b)Interactions with children, including matters set out in Regulations 155 and 156, supporting inclusive practice and positive behaviour support. c)Protecting children from harm and hazard and assessing risk. d)Dealing with complaints, including establishing complaint handling systems that are child safety focused. e)Ensuring certain information is notified to the Regulatory Authority within prescribed timeframes, consistent with Section 174 of the National Law f)Health, hygiene and safe food practices, including allergy management. g)The approved provider must submit evidence of completion to the NSW Early Learning Commission within one week of each initial and subsequent refresher training session. The approved provider must prepare a compliance improvement plan addressing the focus areas detailed above and submit a copy to the NSW early Learning Commission commencing on 26 May 2026. Evidence of quarterly updates must be provided to the Commission via the below email at the conclusion of quarter ensuring that the compliance improvement plan addresses: a)Providing a child safe environment, including matters relating to supervision, promoting a culture of child safety and wellbeing, child protection awareness, and mandatory reporting requirements. b)Interactions with children, including matters set out in Regulations 155 and 156, supporting inclusive practice and positive behaviour support. c)Protecting children from harm and hazard and assessing risk. d)Dealing with complaints, including establishing complaint handling systems that are child safety focused. e)Ensuring certain information is notified to the Regulatory Authority within prescribed timeframes, consistent with Section 174 of the National Law f)Health, hygiene and safe food practices, including allergy management. g)The approved provider must ensure the compliance improvement plan contains, at minimum, the following details: -Relevant section/regulation. -Planned compliance improvement actions. -How the provider will monitor its own compliance and improvement actions. -Improvement action taken. -Date of action taken. -Name and signature of the person responsible for the action. The approved provider must notify all families of children enrolled at the education and care service of these conditions within 7 days of the conditions coming into effect and provide a copy of this notification to the Commission. The approved provider must reduce the educator to child ratio to support supervision practices at the service.
