Approval conditions
The approved provider must ensure that at least one educator, either an individual who meets the qualification requirements in regulation 126(1)(a) or, if one is not available, an individual meeting the requirements of waiver condition 3, is working directly with children at any given time, or is present at the service in the circumstances set out in regulation 123(2A). If the approved provider or, if the approved provider is not an individual, a nominated supervisor of the service, is satisfied on reasonable grounds that an individual, who holds at least an approved certificate III level education and care qualification, also has the skills and knowledge to be able to perform the role of an educator with an approved diploma level education and care qualification, that individual may be placed to satisfy condition 2 The approved provider or nominated supervisor must make a written record of the grounds on which he or she was satisfied for the purposes of waiver condition 2, and the record must be available for inspection by an authorised officer on the same basis as documents prescribed for the purposes of section 175 of the Law The approved provider must ensure that the number of educators working directly with children, who meet the qualification requirements in regulation 126(1)(a) or the requirements in waiver condition 2, are no less than one fewer than regulation 126(1)(a) would otherwise require.
